Political Challenge to Section 13
In 2008, Liberal MP Dr. Keith Martin
introduced Motion
M-446 before the House of Commons. In the motion, Dr. Martin
asked Parliament "That, in the opinion of the House, subsection 13(1)
of the Canadian Human Rights Act should be deleted from the Act.".
In 2011, Conservative MP Brian Storseth introduced Bill C-304,
An Act to amend the Canadian Human Rights Act (protecting freedom).
The bill is currently working it's way through Parliament.

BILL C-304
An Act to amend the Canadian Human Rights Act (protecting
freedom)
Her Majesty, by and with the advice and consent of the Senate and
House of Commons of Canada, enacts as follows:
CANADIAN HUMAN RIGHTS ACT
1. Section 4 of the Canadian Human Rights Act is replaced by the
following:
4. A discriminatory practice, as described in sections 5 to 14.1,
may be the subject of a complaint under Part III and anyone found to
be engaging or to have engaged in a discriminatory practice may be
made subject to an order as provided in section 53.
2. Section 13 of the Act is repealed.
3. Paragraph 40(5)(b) of the Act is replaced by the following:
(b) occurred in Canada and was a discriminatory practice within
the meaning of section 5, 8, 10 or 12 in respect of which no
particular individual is identifiable as the victim;
4. The portion of subsection 53(2) of the Act before paragraph
(a) is replaced by the following:
(2) If at the conclusion of the inquiry the member or panel finds
that the complaint is substantiated, the member or panel may make an
order against the person found to be engaging or to have engaged in
the discriminatory practice and include in the order any of the
following terms that the member or panel considers appropriate:
